China Found Dumping & Subsidizing Solid Wire

• On June 4, the Department of Commerce (Commerce) announced its affirmative final determinations in the antidumping duty (AD) and countervailing duty (CVD) investigations on imports of certain wire decking from the People’s Republic of China (China).
• Dumping occurs when a foreign company sells a product in the United States at less than fair value. Subsidies are financial assistance from foreign governments that benefit the production, manufacture, or exportation of goods.
• Commerce determined that Chinese producers/exporters have sold wire decking in the United States at 14.24 to 143.00 percent less than normal value.
• In the AD investigation, mandatory respondents, Dalian Huameilong Metal Products Co., Ltd. (“DHMP”), and Dalian Eastfound Metal Products Co., Ltd. (“Eastfound Metal”) and its affiliate Dalian Eastfound Material Handling Products Co., Ltd., received final dumping rates of 17.75 and 14.24 percent, respectively.
• Three other companies qualified for a separate rate of 16.00 percent. All other Chinese producers/exporters will receive a final dumping rate of 143.00 percent.
• In the CVD investigation, Commerce determined that Chinese producers/exporters have received net countervailable subsidies of 1.52 to 437.11 percent.
• Mandatory respondents, DHMP and Eastfound Metal, received net subsidy rates of 1.52 and 3.55 percent, respectively. Those companies which were non-responsive to Commerce’s Quantity and Value questionnaire received an adverse rate of 437.11 percent. All otherChinese exporters received a final net subsidy rate of 2.54 percent.
• As a result of the final determination of sales at less than fair value, Commerce will instruct U.S. Customs and Border Protection (CBP) to collect a cash deposit or bond of estimated antidumping duties based on the final dumping rates. Should the International Trade Commission (ITC) issue a final affirmative injury determination, Commerce will also instruct CBP to collect a cash deposit of estimated countervailing duties based on the final net countervailable subsidy rates.
• The petitioners for these investigations are AWP Industries, Inc. (KY), ITC Manufacturing, Inc. (AZ), J&L Wire Cloth, Inc. (MN), Nashville Wire Products Mfg. Co., Inc. (TN), and Wireway Husky Corporation (NC).
• The product covered by these investigations is welded-wire rack decking produced from carbon or alloy steel wire that has been welded into a mesh pattern. The wire mesh is reinforced with structural supports and designed to be load bearing. Wire decking reinforced with structural supports is designed generally for industrial and other commercial storage rack systems.
• The product covered by these investigations is currently classified in the Harmonized Tariff
Schedule of the United States (HTSUS) under item number: 9403.90.8040. Wire Decking

• Imports of wire decking from China were valued at an estimated $235.9 million in 2009.
However, this includes certain HTSUS subheadings which are basket categories covering not
only subject merchandise, but also other metal furniture parts.
NEXT STEPS
• The ITC is scheduled to make its final injury determination on or about July 2010.
• If the ITC makes an affirmative final injury determination that imports of wire decking from China materially injure, or threaten material injury to, the domestic industry, Commerce will issue AD and CVD orders.
