<p>- / N2N / &#8211; I have an acquaintance who owns a small, non-asset third party logistics (3PL) company.  He is constantly complaining to me about how cutthroat the transportation business is and how his customers and vendors are always cheating him out of money.  He spends a great deal of time trying to collect money and often ends up having to sue companies in order to get them to pay.</p>
<p>I’ve been involved in the transportation industry for a little over three years now and I can tell you that my experience has been exactly the opposite of that of my friend’s.  In three years I haven’t had a single customer stiff me for so much as a penny.  Sure, there’ve been a few slow-pays, but that’s to be expected.  In these 3 years I’ve met a lot of good people and I now consider many of them to be friends.</p>
<p>As a consultant that helps companies get C-TPAT certified my primary customers are importers, NVOCC’s (non vessel operating common carriers / international freight forwarders), U.S. Customs Brokers and Cross-Border Highway Carriers.  I also offer a program called “C-TPAT Compliant” for those companies that aren’t eligible for C-TPAT certification such as draymen, customs bonded warehouses, domestic trucking companies, most 3PL&#8217;s and domestic shipping and distribution companies. I think that’s a pretty good cross-section of the industry.  Even so, I’ve never encountered anyone who’s tried to cheat me.</p>
<p>Maybe I’ve just been lucky or maybe I’m just plain naive.  But what about you?  I’d be very interested to hear about your experiences.  I’m sure there are probably a lot of horror stories out there, but I’ll bet there are also some nice stories about transportation companies watching out for each other and stepping up to do the right thing.</p>

<p>- / N2N / &#8211; UPS (NYSE: UPS) has activated its newly-created Logistics Action Teams  (LAT) to support the American Red Cross&#8217;s relief efforts for victims of  the recent tornadoes in the southeastern United States.</p>
<p>Additionally, the company pledged an additional $100,000 to its  original $500,000 commitment to the American Red Cross and made a  $50,000 contribution to the Metropolitan Atlanta Chapter of the Red  Cross, also earmarked for emergency relief for tornado victims.</p>
<p>LATs were established in January to leverage UPS&#8217;s transportation  network, logistics expertise and far-reaching employee volunteer base  for the benefit of the Red Cross during natural disasters and  emergencies. The LAT approach was modeled after the World Food  Programme&#8217;s Logistics Emergency Teams, which utilize logistics experts  from private companies like UPS in times of crisis. This is the first  deployment of a UPS LAT team, one of four created so far and assigned to  the Metropolitan Atlanta Chapter. In addition to Atlanta, UPS has  trained LAT teams to work with the Red Cross in San Francisco, Houston  and Louisiana.</p>

<p>In addition to the Atlanta team&#8217;s efforts, UPS also is managing  emergency supply shipments to Alabama and Mississippi for the Red  Cross&#8217;s national office.</p>
<p>&#8220;The UPS Logistics Action Team has been invaluable to our tornado  relief operation,&#8221; said Nancy Brockway, Chief Emergency Services Officer  for Metro Atlanta Chapter of the American Red Cross. &#8220;Their expertise  has helped us be more efficient in transporting meals and supplies to  the families who so desperately need them.&#8221;</p>

<p>Mark Krause, a UPS operations division manager, is working directly  with the Red Cross&#8217;s Logistics Command Center in Atlanta. His current  assignment is working with the local Red Cross Bulk Distribution Manager  to help coordinate relief efforts in Georgia. Projects underway  include:</p>
<ul>
<li>Bulk distribution of clean-up supplies to the hardest hit areas.</li>
<li>Pick-up and delivery of hot meals to fixed feeding sites.</li>
<li>Transportation of documents, equipment and supplies from warehouses to service delivery sites.</li>
<li>Operation of daily pick-up and delivery routes between Red Cross warehouses and affected areas.</li>
</ul>
<p>This week, UPS volunteers saw the benefits of recent donations of  time and labor. On April 15 in Atlanta, the employees on their day off  cut huge donated linoleum sheeting for use to protect school gymnasium  floors used for shelters. That sheeting has been delivered to schools  around the region.</p>
<p>UPSers also got a &#8220;thank you&#8221; from the mayor of Geiger, Ala., who  asked UPS to lend the town two 53-foot trailers to protect personal  items that were retrieved after the storms.</p>
<p>The Red Cross partnership and recent activation in the Southeast are  extensions of The UPS Foundation&#8217;s innovative use of logistics experts  for humanitarian relief around the globe.</p>
<p>Yuki Muramatsu, UPS Japan, has been assigned to the World Food  Programme Logistics Emergency Team (LET) in Tokyo to support relief  efforts for earthquake victims there. She began on March 23 and  continues to serve as the LET lead coordinator, responsible for handling  all incoming relief shipments for the WFP including warehouse  management, customs clearance and transportation to the impacted areas.</p>
<p>Other recent UPS humanitarian relief activities include grants to the  Red Cross of Columbia (Cruz Roja Colombiana) after extensive floods and  mudslides; shipments of relief supplies to refugees in Tunisia and  Liberia for CARE and the UNHCR, respectively, and continued shipping of  goods for Japan relief efforts.</p>

Deputy Secretary of Energy Daniel Poneman and Vice Minister SUN Yibiao of the General Administration of China Customs signed the MOU in a ceremony at DOE headquarters in Washington. The signed comes as part of Chinese President Hu Jintao&#8217;s state visit to Washington, DC.</p>
<p>&#8220;This agreement represents the shared commitment of both the United States and China to enhance global peace and security by working to prevent nuclear smuggling,&#8221; said Deputy Secretary of Energy Daniel Poneman. &#8220;Preventing illicit transfers of nuclear materials is a critical part of NNSA&#8217;s efforts to implement President Obama&#8217;s goal of securing vulnerable nuclear material around the world. The success of this program is due in no small part to continued and future cooperation and support from partners such as the People&#8217;s Republic of China.&#8221;</p>
<p>NNSA is working to expand and strengthen nonproliferation efforts throughout East Asia. Through its Second Line of Defense (SLD) program, NNSA will provide radiation detection equipment and support the development of training materials for use at the Qinhuangdao Training Center. The radiation detection training facility at the Qinhuangdao Training Center will be the first of its kind in the region.</p>
<p>This agreement will complement ongoing cooperative efforts established by a 2005 MOU to combat nuclear and radiological smuggling. The 2005 agreement supports NNSA&#8217;s Megaports Initiative, which is working to equip the Yangshan Deepwater Port in Shanghai with radiation detection equipment.</p>
<p>NNSA&#8217;s SLD program works collaboratively with foreign governments at land border crossings, airports and seaports to install specialized radiation detection equipment, mobile radiation detection equipment, and associated communications equipment. Through its SLD program, NNSA also provides training to host government law enforcement officers and other personnel to detect smuggled nuclear and other radioactive materials.</p>

This year, CBP will be hosting two seminars due to the interest of previous events and to expand the opportunity to as many member companies to attend as possible. The first seminar will be held in San Diego, California on March 29-31, 2011. The second seminar will be held in New Orleans, Louisiana on June 8-9, 2011. This year’s theme is “A Decade of Supply Chain Security and Innovation”.</p>
<p>Registration for the seminar is free, but only C-TPAT certified or validated companies may attend. CBP allows each company to have up to two (2) employees attend either event, but not both. The seminar in San Diego will be limited to 1,200 participants. The seminar in New Orleans will be limited to 600 participants.</p>

<p>There will be no registration fee for this seminar; however space is limited to 1,200 participants in San Diego and 600 participants in New Orleans.</p>
<p>C-TPAT Training Seminar Registration for both conferences will be conducted via an on-line registration process beginning January 5, 2011. Registration will open at 12:00 Noon Eastern Standard Time (9:00 AM Pacific Standard Time).  Each company will be required to pick one seminar only for two participants. You must have your C-TPAT account number to register. If you do not have it immediately available, you will not be able to register in a timely manner!</p>
<p>Attendees will be selected based on certified membership status and on a first come first served basis. Tier 3 members will be given preference for the event they choose.  Attendance is limited to a maximum of two (2) persons per C-TPAT certified account. At least one person registering to attend must be a designated point of contact (POC) listed in the company’s C-TPAT Portal account. <p>Recognizing that nearly 1,000 families in the Greater New Orleans region are still in FEMA trailers or temporary housing, UPS has partnered with the St. Bernard Project and United Way’s NO Place Like Home campaign to move local families from temporary housing back into their own permanent homes.</p>
<p>In addition to the move-in, volunteers will also work on the construction of three new homes for Katrina-affected families.</p>
<p>Executives and volunteers from UPS, United Way and the St. Bernard Project will be on hand as well as The Treaudo family and other families affected by Hurricane Katrina.</p>
<p>Volunteers will be rebuilding homes, planting and painting. The volunteers will also be helping move displaced families into their new homes.</p>
<p>This isn’t the first time that UPS has aided victims of Hurricane Katrina. The UPS Foundation initially donated $1.25 million toward relief efforts in 2005, but since then UPS has donated a total of more than $2 million and countless volunteer hours to recovery efforts.</p>

Second quarter 2009 net income included $72 million, or $0.14 per diluted share, related to a Colorado land sale.</p>
<p>&#8220;Beyond strong earnings growth, the real highlight was achieving a 69.4 percent operating ratio – our first sub-70 quarterly mark, &#8221; said Jim Young, Union Pacific chairman and chief executive officer. &#8220;We demonstrated great volume leverage, efficiently handling an 18 percent increase in carloadings at modest incremental cost. This is a tremendous achievement for the men and women of UP, who not only operated a very safe and efficient network, but also drove an all-time-high for customer satisfaction.&#8221;</p>
<p>Second Quarter Summary</p>
<p>Second quarter business volumes, as measured by total revenue carloads, grew 18 percent versus the prior year&#8217;s recession-impacted levels. This is the first time in six years that all six Union Pacific business groups reported volume growth in the same quarter.  Quarterly operating revenue increased 27 percent in the second quarter 2010 to $4.2 billion versus $3.3 billion in the second quarter 2009. In addition:</p>
<p>* Freight revenues for all six business groups increased in the second quarter, up 27 percent versus 2009 to a total of $4.0 billion. Driving the increase were double-digit volume growth, increased fuel cost recoveries and core pricing gains.<br />
* Quarterly diesel fuel prices increased 46 percent from an average of $1.57 per gallon in the second quarter 2009 to an average of $2.29 per gallon in the second quarter 2010.<br />
* Union Pacific&#8217;s operating ratio was a best-ever 69.4 percent, an 8 point improvement versus 2009. Strong volume growth combined with ongoing efficiency initiatives and quarterly pricing gains drove the record performance.<br />
* The Company&#8217;s Customer Satisfaction Index of 89 was a quarterly best and 2 points better than the second quarter 2009.<br />
* Quarterly train speed, as reported to the Association of American Railroads, was 26.4 mph, down 4 percent versus record velocity in the second quarter 2009. Operations were slowed by June flooding in the Midwest and network infrastructure replacement and improvement programs.<br />
* The Company repurchased nearly 6.5 million shares in the second quarter 2010 at an average share price of $71.74, and aggregate cost of approximately $466 million.</p>

William Owens [D-NY23] introduced H.R. 5619, which will allow many non-asset logistics companies to obtain <a href="http://combinationsales.com/get-c-tpat-certified/">Customs-Trade Partnership Against Terrorism (C-TPAT) Certification</a>.  The Safe Port Act, which was passed after the 911 terrorist attacks specifically included non-asset logistics providers involved in the international supply chain to be eligible for certification, but CBP has given these companies a thumbs down without offering an explanation.  This bill will force CBP to allow certification for non-asset logistics providers such as 3PL&#8217;s (Third Party Logistics).</p>

<p>There is certain to be a rush of logistics companies  to become <a href="http://combinationsales.com/get-c-tpat-certified/">C-TPAT Certified</a> after the passage of this bill.  Logistics providers should strongly consider becoming <a href="http://combinationsales.com/c-tpat-complian/">C-TPAT Compliant</a> immediately, because this will make certification a substantially easier and faster process once it is available.</p>

<p>Mr. OWENS introduced the following bill; which was referred to the Committee on Homeland Security</p>
<p>A BILL</p>
<p>To amend the SAFE Port Act to provide for the eligibility of certain third party logistics providers for participation in the Customs-Trade Partnership Against Terrorism program.</p>
<p>Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</p>
<p>SECTION 1. ELIGIBILITY OF CERTAIN THIRD PARTY LOGISTICS PROVIDERS FOR PARTICIPATION IN C-TPAT PROGRAM.</p>
<p>(a) In General- Section 212 of the SAFE Port Act (Public Law 109-347; 6 U.S.C. 962) is amended by inserting after ‘contract logistics providers,’ the following: ‘non-asset based third party logistics providers that arrange international transportation of freight, including motor carrier brokers of property licensed by the Department of Transportation,’.</p>
<p>(b) Effective Date-</p>
<p>(1) IN GENERAL- The amendment made by subsection (a) takes effect on the date of the enactment of this Act and applies with respect to applicants seeking to participate in the Customs-Trade Partnership Against Terrorism (‘C-TPAT’) program on or after the date on which the regulations published pursuant to paragraph (2) take effect.</p>
<p>(2) REGULATIONS- The Secretary of Homeland Security, acting through the Commissioner responsible for United States Customs and Border Protection of the Department of Homeland Security, shall publish in the Federal Register criteria for participation in C-TPAT program of non-asset based third party logistics providers described in section 212 of the SAFE Port Act, as added by subsection (a), not later than 60 days after the date of the enactment of this Act.</p>

			<content:encoded><![CDATA[<p>PLANTATION, Fla. &amp; CHICAGO &#8211; / N2N / &#8211; Pizzas 4 Patriots, a non-profit organization, is teaming up with DHL Express, the world’s leading global express delivery and logistics company, and AT&amp;T to send thousands of Edwardo’s Natural pizzas to U.S. servicemen and women overseas in time for Independence Day, 2010.</p>
<p>This Independence Day, U.S. servicemen and women at bases in Iraq, Afghanistan as well as South Korea will get a taste of home – Chicago and New York Style. Over 5,000 Award Winning Stuffed Pizzas from Edwardo’s Natural Pizza in Chicago, along with hundreds of pizzas from New York Flying Pizza will leave the U.S. on June 26, in time for Independence Day celebrations at U.S. military bases. DHL Express has donated its global shipping network for the delivery.</p>
<p>According to Ret. MSgt Mark Evans of Pizzas 4 Patriots, his non-profit has been incrementally gearing up to expand pizza deliveries to the U.S. servicemen and women stationed across the world, with this July 4 adding a special distribution to those stationed in Korea.</p>
<p>“We should never forget the sacrifices of the men and women based around the world that defend our freedoms and those of our allies, which is why we have been working to expand our distribution to all regions of the world where U.S. Commands are based,” said Ret. MSgt Mark Evans. “Since we started Pizzas 4 Patriots, the letters of appreciation that we get from the military as well as from friends and family of those stationed overseas is really heartwarming and makes it all worthwhile.”</p>
<p>The mission to show appreciation and bring reminders of home to the men and women in uniform overseas was conceived by Ret. MSgt. Mark Evans of Elk Grove Village, Ill. In 2008, Evans’ 15-year-old son Kent asked if there was a way to deliver freshly-frozen Chicago-style pizzas to servicemen and women stationed throughout Iraq in time for July Fourth Independence Day Celebrations. The initial effort required 2,000 pizzas and was extremely well received. Since the first effort, and with the support of DHL Express, Evans has been able to ship over 45,000 pizzas to U.S. military personnel overseas.</p>
<p>Over 5,000 pizzas, packaged in temperature-cooled containers, will be picked up at the Edwardo’s National Pizza restaurant on Wednesday, June 23 at 10:00 a.m. in Wheeling, Illinois for a formal send-off event. The pizzas, along with letters of support to the troops, will be transported from Chicago to DHL’s hub at the Cincinnati/Northern Kentucky Airport where they will move onward to regional DHL hubs in the Middle East and Asia. DHL provides door-to-door, final mile delivery for the entire distribution, working closely with the U.S. military to ensure the pizzas are delivered fresh and ready to heat and serve at various military bases.</p>
<p>DHL has been selected by the Department of Defense for service to numerous locations around the globe based on the extensive service capabilities and &#8220;first in market&#8221; approach provided in support of US servicemen and women. DHL was also the first international air express carrier to provide service to Iraq and Afghanistan, and operates the most extensive logistics service in the Middle East Region.</p>

• On June 4, the Department of Commerce (Commerce) announced its affirmative final determinations in the antidumping duty (AD) and countervailing duty (CVD) investigations on imports of certain wire decking from the People’s Republic of China (China).<br />
• Dumping occurs when a foreign company sells a product in the United States at less than fair value. Subsidies are financial assistance from foreign governments that benefit the production, manufacture, or exportation of goods.<br />
• Commerce determined that Chinese producers/exporters have sold wire decking in the United States at 14.24 to 143.00 percent less than normal value.<br />
• In the AD investigation, mandatory respondents, Dalian Huameilong Metal Products Co., Ltd. (“DHMP”), and Dalian Eastfound Metal Products Co., Ltd. (“Eastfound Metal”) and its affiliate Dalian Eastfound Material Handling Products Co., Ltd., received final dumping rates of 17.75 and 14.24 percent, respectively.<br />
• Three other companies qualified for a separate rate of 16.00 percent. All other Chinese producers/exporters will receive a final dumping rate of 143.00 percent.<br />
• In the CVD investigation, Commerce determined that Chinese producers/exporters have received net countervailable subsidies of 1.52 to 437.11 percent.<br />
• Mandatory respondents, DHMP and Eastfound Metal, received net subsidy rates of 1.52 and 3.55 percent, respectively. Those companies which were non-responsive to Commerce’s Quantity and Value questionnaire received an adverse rate of 437.11 percent. All otherChinese exporters received a final net subsidy rate of 2.54 percent.<br />
• As a result of the final determination of sales at less than fair value, Commerce will instruct U.S. Customs and Border Protection (CBP) to collect a cash deposit or bond of estimated antidumping duties based on the final dumping rates. Should the International Trade Commission (ITC) issue a final affirmative injury determination, Commerce will also instruct CBP to collect a cash deposit of estimated countervailing duties based on the final net countervailable subsidy rates.<br />
• The petitioners for these investigations are AWP Industries, Inc. (KY), ITC Manufacturing, Inc. (AZ), J&amp;L Wire Cloth, Inc. (MN), Nashville Wire Products Mfg. Co., Inc. (TN), and Wireway Husky Corporation (NC).<br />
• The product covered by these investigations is welded-wire rack decking produced from carbon or alloy steel wire that has been welded into a mesh pattern. The wire mesh is reinforced with structural supports and designed to be load bearing. Wire decking reinforced with structural supports is designed generally for industrial and other commercial storage rack systems.<br />
• The product covered by these investigations is currently classified in the Harmonized Tariff<br />
Schedule of the United States (HTSUS) under item number: 9403.90.8040. Wire Decking<br />
may also be entered under HTSUS 7217.10.1000, 7217.10.2000, 7217.10.3000, 7217.10.4030,<br />

• Imports of wire decking from China were valued at an estimated $235.9 million in 2009.<br />
However, this includes certain HTSUS subheadings which are basket categories covering not<br />
only subject merchandise, but also other metal furniture parts.<br />
NEXT STEPS<br />
• The ITC is scheduled to make its final injury determination on or about July 2010.<br />
• If the ITC makes an affirmative final injury determination that imports of wire decking from China materially injure, or threaten material injury to, the domestic industry, Commerce will issue AD and CVD orders.</p>
